Pioneer Supply Quote Terms

Quantities and descriptions listed are not guaranteed as being correct, insofar as the actual project requirements are concerned.  Pioneer Supply will furnish such items in the quantity and of the descriptions as listed, subject to the prior approval of the project engineer or owner.Fabricated flange pipe is quoted as approximate lengths.  Customer must provide dimensions for actual lengths to be furnished.  Fabricated flange pipe is made to order and will not be returned for credit. All orders are subject to strikes, accidents, truck supply, or delays from causes beyond our control including, without limitation, acts of God, pandemic and pandemic-related conditions, and other conditions which are typically recognized as events of Force Majeure.  Quotations are based on the freight rate in effect at the time prices are offered, F.O.B. Incoterms 2020, at project site or Pioneer Supply’s warehouse, as applilcable and are subject to change. If any material should prove defective, under no circumstances shall we be responsible for any damages or claims beyond the cost of the repair or replacement of such materials.  No charges for labor or expenses required to repair or replace defective material will be allowed to be charged back to Pioneer Supply.  All materials claimed to be defective shall be held subject to inspection by a representative of Pioneer Supply and/or the manufacturer.  In the event the materials are proven to be defective, the exclusive measure of damages is the purchase price of the damaged goods and all other damages are hereby waived to the full extent of applicable law.  A credit will not be issued until the materials are returned to us. Claims for shortages and defects must be promptly presented in writing or such claims will not be allowed.  No unused materials will be accepted for return without the express written approval of Pioneer Supply. Authorized returns may be subject to an administrative fee not to exceed 25% of original purchase price of the returned materials. All orders are accepted subject to approval of the credit department. Terms and conditions cannot be modified except in writing and signed by an authorized representative of Pioneer Supply.
